EDiMA reaction to Trilogue decision to modernise EU consumer law

BRUSSELS 22 March 2019 – EDiMA* would like to congratulate the Romanian Presidency in reaching a trilogue agreement. We regret, however, that the amendments to the Commission’s proposal have watered down the principle of full harmonization across the EU and are counter to the realisation of the Digital Single Market in Europe.

EDiMA Director General, Siada El Ramly said: ‘These changes to EU consumer law may well result in Member States introducing new, diverging regulations and provisions for the treatment of online platforms. Any such legal fragmentation may undermine consumers’ rights when buying cross-border as well as preventing seamless business across the EU.

‘We are similarly concerned about the practical implications of overly prescriptive requirements and the extension to the list of unfair commercial practices. Without an appropriate impact assessment, or evidence on the scale or nature of the problem, we remain doubtful about the added-value to consumers.’

EDiMA and its member organisations would like to reiterate support for effective consumer protection and enforcement within the single market while keeping in mind. We welcome the Commission’s 2017 analysis of EU consumer rules (REFIT) that confirmed that the current EU consumer legal framework addresses effectively the need for consumer trust in the online world.
