DSA Consultation: Protect users with responsibility framework

EDiMA, the voice of the leading internet companies and the most popular internet products in Europe, submitted its feedback to the EU consultation on the Digital Services Act today.

Commenting on the submission, Siada El Ramly, Director General said:

“Our members take our responsibility seriously and are ready to play their part. Introducing a responsibility framework as part of the Digital Services Act will be the single best way to protect users online. We’re ready to engage with everyone involved as the Digital Services Act discussions continue”.

In its submission, EDiMA has highlighted a number of key elements to enhance the protection of users online and to create an environment where new innovative services can thrive:

  • The need to create legal certainty, safeguards and incentives for online service providers to take proactive action beyond the legal requirements to protect users.
  • The need to reaffirm the three key principles of the e-Commerce Directive (the Country of Origin Principle, the Limited Liability regime and the Prohibition of a General Monitoring Obligation).
  • The need to treat illegal and harmful content differently.
  • The need to clarify the notice and action system.
  • The need to create a robust framework that will accommodate the wide variety of services already in place and under development.

To complement their consultation submission, EDiMA published yesterday a paper outlining the importance of maintaining the three key principles of the e-Commerce Directive (available here). This is the first in a series of papers that EDiMA will publish expanding on their paper from earlier this year calling for the introduction of a responsibility framework available here).
